To File or Not to File - the Uncollectible Debtor

Is there really such a thing as a “collection proof” debtor?  If such debtors exist, is bankruptcy still a good option for them or if it isn’t, how do you advise these near mythical debtors?  This seminar will examine the ethical and practical concerns of advising uncollectible debtors and the sometimes “moving target” of their assets.

Discussion of ethical issues surrounding bankruptcy representation: confidentiality, candor, duties of reasonable investigation (and potential attorney sanctions); will be a practical discussion of how to determine your ethical duties and investigatory responsibility from the perspective of the initial consultation.

Brant Hodyno graduated from St. John's University School of Law (J.D., cum laude, 2004), where he took special interests in Consumer Advocacy and Therapeutic Jurisprudence. He attended the University of Miami School of Law (LL.M., Real Property Development and Finance, 2005), and spent several years working in litigation representing large corporations. In 2016, Attorney Hodyno started his own law practice, Compassionate Counsel, refocusing his career on helping individuals resolve their consumer debt via bankruptcy, negotiation, asset protection, or other creative solution.
Daniel J. Rylander, a native Minnesotan, has lived in Tucson since 1990. He graduated from St. Cloud State University in St. Cloud, Minnesota, in 1982. Obtaining his law degree from the University of Arizona in 1993, he has worked in private practice in Tucson ever since. Mr. Rylander’s practice has primarily concentrated on consumer debtor representation in the United States Bankruptcy Court, as well as defending consumers against abuse by creditors.
